Terms of Service

These Terms of Service govern your use of creators.softmoc.com (the "Site") and the SoftMoc Creators Program (the "Program") operated by MWF Group Inc. ("SoftMoc", "we", "us"). By using the Site or participating in the Program, you agree to these Terms.
1. Acceptance
Accessing the Site or submitting a Program application constitutes acceptance of these Terms and the Privacy Policy. If you do not agree, do not use the Site or apply to the Program.
2. Eligibility
You must be at least 18 years old, legally able to enter contracts in your jurisdiction, and comply with the platform terms of any social channel you use (Instagram, TikTok, YouTube).
Approval into the Program is at SoftMoc's sole discretion and may be revoked at any time.
3. Your Account
You are responsible for the accuracy of your application details, the security of your credentials, and enabling two-factor authentication on first login. You are responsible for all activity under your account.
4. Prohibited Conduct
You may not misrepresent your identity, followers, or endorsement relationship; scrape or attempt to breach the Site; interfere with other creators' referral traffic; or use the Site or the Program to publish unlawful, defamatory, or brand-unsafe content.
5. Content You Submit
You retain ownership of the content you post. You grant SoftMoc a non-exclusive, worldwide licence to display application data, referral posts, and disclosure evidence within the Site and internal reporting.
6. Intellectual Property
"SoftMoc", the SoftMoc logo, and related marks are trademarks of MWF Group Inc. You may use them only as expressly permitted by the Affiliate Agreement and any brand guidelines we provide.
7. Disclaimers
The Site is provided on an "as-is" and "as-available" basis. SoftMoc disclaims all implied warranties to the fullest extent permitted by law.
8. Limitation of Liability
To the maximum extent permitted by law, SoftMoc's aggregate liability arising out of the Site or the Program will not exceed the commissions paid to you in the twelve months preceding the claim.
9. Changes
We may update these Terms; material changes will be posted on this page with an updated date. Continued use of the Site after changes constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Exclusive jurisdiction lies with the courts of Ontario.
